NY's Offshore Wind Initiative: The Legal Path Forward

New York State is implementing an aggressive policy for the development of offshore wind energy. This will entail both environmental and permitting reviews raising myriad legal issues associated with the onshore development required to support the construction and operation of offshore wind projects. In addition, to be economically viable state-level procurement mechanisms will have to be put into place to allow developers to recoup the costs of deploying turbine arrays miles out in the Atlantic Ocean. The use of such procurement strategies raises another host legal issues.
